APPLICATION PERIOD FOR SHORT-TERM WORKING AND SHORT-TERM WORKING ALLOWANCE EXTENDED

As it is known, there is a rapid increase in the spread of the New Coronavirus (COVID-19) pandemic all over the world and especially in Europe and there is a serious increase in the number of cases and patients also in our country. Within this period, while taking measures to protect the public health, it is aimed to protect economic stability and employment at the same time. Within this scope, the New Coronavirus (COVID-19) pandemic disease has been accepted as “periodic compelling reason arising from external effects” and regulations have been made in this area until today. The latest regulation concerning to the subject was made with the Presidential Decisions No. 3316 and 3317 published in the Official Gazette dated 23/12/2020 and numbered 31343 and the application period for short-time working allowance and the period of short-time working have been extended.

Application Period For Short-Term Working

The application period for short working allowance made within the scope of “periodic compelling reasons arising from external effects” due to the New Coronavirus (COVID-19) expired on 30/06/2020 in accordance with the first paragraph of the provisional article 23 of the Unemployment Insurance Law No. 4447. However, as a result of the latest developments, the application period for the short-time working allowance has been extended until 31/12/2020 in accordance with the Presidential Decision No. 3238 published in the Official Gazette dated 01/12/2020 and numbered 31321. In accordance with this amendment, it has been stated that all employers who did not or do not apply for short-term working until this date can apply to Turkish Employment Agency ( İŞKUR ) for short-time working until 31/12/2020 for “periodic compelling reasons arising from external effects” due to the New Coronavirus (COVID-19) and they can benefit from the short-time work allowance for the period after 1/12/2020.

This aformentioned application period for the short-time working allowance extended until 31/1/2021 with the Presidential Decision No. 3316 published in the Official Gazette dated 23/12/2020 and numbered 31343, within the framework of the principles stated in the Presidential Decision No. 3238 dated 30/11/2020.

In this context, all workplaces that have not applied for short-time working before will be able to apply for short-time working to Turkish Employment Agency (İŞKUR) until 31/1/2020 due to compelling reasons within the scope of periodic situations arising from external effects due to New Coronavirus (COVID-19). Workplaces that have previously applied for short work will also be able to apply by notifying the workers who have not previously benefited from short-time working allowance until the specified date.

Period For Short-Term Working Allowence

Period of short-time working allowance for workplaces where short-time working is applied within the scope of “periodic compelling reason arising from external effects” due to the New Coronavirus (COVID-19) has been extended to 31/12/2020 in accordance with the Presidential Decision No. 3134 published in the Official Gazette dated 27/10/2020 and numbered 31287.

This aformentioned period for the short-time working allowance extended until 28/2/2021 with the Presidential Decision No. 3317 published in the Official Gazette dated 23/12/2020 and numbered 31343 for the workplaces that have applied for short-time working until 31/12/2020 (including this date). In this context, short-time working allowance will continue to be benefited until the mentioned date.
