In accordance with the Personal Data Protection Board’s Decision dated 06/07/2023 and numbered 2023/1154 (“Decision”) published in the Official Gazette dated 25/07/2023; for data controllers whose main field of activity is not processing sensitive personal data, the annual financial balance sheet total limit subjected to the obligation to register with the Data Controllers Registry (“VERBİS”) has been increased from 25 million Turkish Liras to 100 million Turkish Liras.
In accordance with our country’s economic conditions, the Personal Data Protection Authority has decided to change the expression “real or legal person data controllers with less than 25 million Turkish Liras whose main field of activity is not the processing of sensitive personal data ” expression to “real or legal person data controllers with less than 100 million Turkish Liras whose main field of activity is not the processing of sensitive personal data” regarding the previously accepted annual financial balance sheet total amount.
It is important to highlight that this Decision, which became effective on July 25, 2023, will serve as the foundation for declarations made after that date by the relevant data controllers.
The fact remains that, in line with the change, real or legal person data controllers whose annual number of employees is less than 50, whose annual financial balance sheet total is less than 100 million Turkish liras, and whose main field of activity is not processing sensitive personal data, will be exempt from the obligation to register on VERBİS. However, the data controllers who register with VERBİS are required to keep their information up-to-date and are able to request the deletion of their registrations from VERBIS. For deletion requests, they must first create a request before the relevant website of VERBİS and then file a petition to the Personal Data Protection Authority.
