Unfair competition law in the light of New Turkish Commercial Code protects coequally the consumers and other market participants as well as the competing undertakings. This position affects undoubtedly the number of the cases to be opened in the event of the unfair competition committed through the press as far as unfair competition activities committed directly by the press.
The legislative in Turkish Law regularizes particularly the responsibility of the press due to the reason of the unfair competition. The legislative has paid particular importance to the responsibility of the press in the event of the unfair competition, due to the fact that the unfair competition activity occurred particularly through the press could reach a wide public.
The unfair competition activities committed through the press as well as the unfair competition activities committed directly by the press, responsibilities of the persons concerned and cases opened against the responsibles are examined by the comparison in the light of Law No. 6762 and Law No. 6102 in our study.
